1. Introduction

This Privacy Policy explains how EvoHire Inc., ("EvoHire,") collects, uses, discloses, and protects information in connection with our AI-powered recruitment platform and related services (the "Service").

This policy applies to information we process for our users who create accounts and manage job screenings ("Users") and on behalf of our Users for the job candidates they invite to use the Service ("Candidates").

By accessing or using our Service, you signify that you have read, understood, and agree to EvoHire’s collection, storage, use, and disclosure of personal information as described in this Privacy Policy and our Terms of Service.

2. Information We Collect

We collect different types of information depending on your interaction with our Service.

A. Information from Users:

  • Account Information: When a User, registers for an account, EvoHire collects your corporate name and contact information, name, email address, and password.
  • Payment Information: EvoHire uses a third-party payment processor to handle payments. EvhHire does not itself collect or store full payment card details. The payment processor provides us with confirmation of payment and limited information like the last four digits of your card for identification purposes. EvoHire will provide a link to its then current payment processor’s terms and privacy policy on request.
  • Job Information: EvoHire collects the information users provide when creating a job posting, such as job descriptions and required skills.
  • Usage and Device Information: EvoHire automatically collects information about how Users use the Service, such as IP address, browser type, device information, operating system, and pages visited.

B. Information from Candidates: When a User invites a Candidate to an interview, EvoHire processes the Candidate's information on the User's behalf. The User is responsible for providing necessary disclosures and obtaining the necessary consent from the Candidate.

  • Contact Information: EvoHire collects the Candidate's phone number or other contact details as provided by the User or the Candidate.
  • Interview Data: EvoHire collects video and audio recordings of the interview, transcripts of the interview, and any other information the Candidate provides in their responses.
  • Analytical Data: EvoHire analyzes the interview Data to generate reports for the User, which may include assessments of answers and behavioral analysis related to potential cheating.

3. How We Use Your Information

EvoHire uses the information we collect for the following purposes:

  • To Provide and Manage the Service: To set up and maintain your account, process payments, conduct AI-powered interviews, and generate analytical reports for our Users.
  • To Communicate With You: By creating an account, you consent to receive service-related emails, such as account verification, billing notifications, and occasional product updates or changes to our services or policies.
  • For Marketing and Promotions: To send you marketing communications about our products and services. You can opt out of these promotional communications at any time.
  • To Improve Our Service: To provide, maintain, and secure the Service; to improve and enhance the Service, including for the purpose of training and refining EvoHire’s artificial intelligence models. All data used for model training will be anonymized and aggregated to protect privacy. EvoHire provides the option to exclude Customer data from AI model training, however, granting this exclusion is at EvoHire's sole discretion and may be restricted to specific enterprise tiers.
  • For Security and Legal Compliance: To protect against fraud and abuse, enforce our Terms of Service, and comply with legal obligations.

4. How We Share Your Information

EvoHire does not sell your personal information. EvoHire share your information in the following circumstances:

  • With Our Users: We share Candidate information, including interview recordings and analytical reports, with the User who initiated the interview.
  • For Legal Reasons: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect our rights or property, or in urgent circumstances to protect the personal safety of users or the public.
  • In a Business Transfer: If EvoHire is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
  • Notwithstanding the general terms of this policy, the collection, use, and disclosure of personal information may be made outside of the terms herein to the extent provided for in any applicable privacy or other legislation in effect from time to time, or pursuant to court orders.

5. Your Data Protection Rights & Choices

You have certain rights and choices regarding your personal information.

  • Access and Update Your Information: You can review and update your User account information by logging into your account settings.
  • Marketing Communications Opt-Out: You may opt out of receiving promotional emails by clicking the "unsubscribe" link in any promotional email we send you, or by contacting us at hello@evohire.ai. Please note that you will continue to receive essential service-related and transactional emails.
  • Data Subject Rights: Depending on your location, you may have the right to request access to, correction of, or deletion of your personal information. To make such a request, please contact us at the email address below. We will respond to your request in accordance with applicable law.

6. Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect the information we collect from loss, theft, and unauthorized use, disclosure, or modification. However, no security system is impenetrable, and we cannot guarantee the absolute security of our systems.

7. Data Retention

We retain personal information for as long as your account is active or as needed to provide you with the Service. We may also retain information to comply with our legal obligations, resolve disputes, and enforce our agreements.

8. Children's Privacy

Our Service is not directed to individuals under the age of 16, and we do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16, we will take steps to delete it.

9. International Data Transfers

Your information may be transferred to, and maintained on, computers located outside of your state, province, or country, including the United States, where the data protection laws may differ from those in your jurisdiction.
